6. Payment and Fees

6.3 Subscription and Renewal

Subscription-based services will automatically renew at the end of each billing period unless you cancel before the renewal date. You are responsible for canceling your subscription to avoid future charges.

6.4 Late Payment and Suspension

If payment is not received when due, we may suspend your access to paid features until payment is received. We reserve the right to charge interest on overdue amounts at the maximum rate permitted by law.

7. Warranties and Disclaimers

We do not warrant that our Services will meet your specific requirements or expectations. You use our Services at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• CYNASOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION
• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF NO PAYMENT WAS MADE
• SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU

9. Indemnification

You agree to indemnify, defend, and hold harmless CYNASOFT, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Any fraudulent or illegal activity

10. Data Protection and Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

• If informal resolution fails, disputes may be resolved through binding arbitration or in the courts of Vancouver, British Columbia
• You waive any right to participate in class action lawsuits or class-wide arbitration

You consent to the exclusive jurisdiction and venue of courts located in Vancouver, British Columbia, Canada for any disputes that are not subject to arbitration.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your account settings
• Contacting our support team
• Ceasing to use our Services

15.2 Termination by Us

We may terminate or suspend your access to our Services immediately, without prior notice, for:

• Breach of these Terms

15.3 Effect of Termination
